Are There Sociologising Tendencies in Hungarian Legal Theory?
Abstract: Sociologizing (using sociological concepts and arguments) within the Hungarian philosophical tradition is not typical in legal theory. The reasons for this lack are historical, scientific and political. There is no sociologizing in Hungarian legal theory. The lack of a concept of society and the scarcity of problem-sensitivity are the result of the history of the development of Hungarian society and politics. In principle, legal sciences and legal theory find it more difficult to accept the basic categories of social theory, and legal thought, which is troubled by modernising and orderly traditions, is particularly incapable of doing so. Sociologisation, the lack of perception of social problems, has long-term consequences. The treatment of the concept of society in theoretical reflections on law does not reflect the possible paths for the science of sociology. Nor are the results of contemporary Western social science brought into the mainstream of the study of law.
